This privacy notice was last updated on 15 June 2026. If we use your personal data for any new purposes, updates will be made to the privacy information and changes communicated, where necessary in accordance with current data protection legislation.  Any queries relating to this Notice should be directed to our DPO (contact details provided above).

What information are we processing?

We may collect, store or otherwise process information about you which may include:

• Full name (first name and surname)
• Date of Birth
• Ethnicity
• Sex
• Disability
• NI Number
• Course details
• Planned learner hours
• Postcode
• Telephone number
• Email
• Prior education level attainment
• Employment status
• Learner outcome
• Whether the learner is care experienced (at learners discretion to answer)

Purpose of collecting or processing your personal data

The DTCCA may need to collect or otherwise process your personal data personal data so that we can;

• Process financial transactions including grants and payments
• Maintain accounts and records
• Provide adult education services
• Administer any corporate activities Devon and Torbay Combined County Authority are required to conduct as a data controller and public authority
• Undertake research and evaluation of the services provided
• Provide reports to governance boards regarding the adult education services
• Support and manage our employees
• Undertake research and evaluation of the services provided
• Support internal financial and corporate functions

The legal basis for us collecting your personal data

Where we are collecting personal data about you for the provision of one of the purposes outlined in this privacy notice, we rely upon;

Article 6(1)(c) – processing that is necessary for DTCCA to fulfil its statutory obligation

Article 6(1)(e) – processing for the purposes of delivering a public task carried out in the public interest

Where we process special category personal data (for example ethnicity, health or information relating to disabilities), this will only take place where an additional lawful basis under Article 9 of the UK GDPR applies.  

In such circumstances, we rely upon UK GDPR Article 9(2)(g) – ‘Substantial Public Interest’, supported by Schedule 1, Part 2, paragraph 6 of the Data Protection Act 2018, (statutory and government purposes).  Processing is necessary to fulfil the requirements of the Apprenticeships, Skills, Children and Learning Act 2009 and Further Higher Education Act 1992.

We do not use personal data collected for the purposes outlined in this notice for direct marketing, and we do not sell personal data to third parties.

Personal data that is collected for any of the purposes outlined in this notice is never used for direct marketing purposes and is not sold on to any other third parties.

Recipients or categories of recipients that we may share your personal data with

When processing your personal data, it may be necessary for us to share personal data with third-party organisations such as;

• Education and Skills Funding Agency
• Department for Education
• Department for Work and Pensions
• Local and Combined Authorities in England
• Higher Education Statistics Agency
• Office for Standards in Education, Children’s Services and Skills (Ofsted)
• Educational institutions and organisations performing research and statistical work on behalf of Devon and Torbay Combined County Authority.

If we feel that it is necessary to share your personal data with professionals to ensure you or someone you work with is safeguarded from harm, we rely upon the provisions of the Safeguarding Vulnerable Groups Act 2006 and Children Act 1989 & 2004.  Where it is necessary to share medical or social care information for these purposes, we rely upon article 9(2)(h) of the General Data Protection Regulation (information necessary for medical diagnosis, the provision of health or social care or treatment or the management of health or social care systems).

We may also need to share some personal data about you, so that we can support third party organisations to discharge their regulatory requirements.  This includes organisations such as;

• The data protection regulator (the Information Commissioner’s Office)
• The Care Quality Commission

We may also share information to enable us to comply with court orders and other legal obligations.  If this is necessary, we will only share the minimum amount of personal data needed for this purpose.

International transfers

Your personal data will not be transferred outside of the United Kingdom or the wider European Economic Area.

How long will we hold your personal data?

The DTCCA will only retain your personal data for as long as is required and no longer; the current retention schedule is 6 years. The data will then be securely removed / disposed of.

Automated decisions

Your personal data will not be processed with the use of technology that will make decisions about any individuals by automated means.
